These Terms & Conditions (“Terms”) apply to every order placed through Gallory (app.gallory.net). By placing an order you accept these Terms. Our registration details are on the Colofon page.
1. What we sell
Gallery works exhibit original, one-of-a-kind artworks. The original artwork remains the property of the artist and is not for sale through Gallory. What you purchase is a print edition of the artwork, produced on demand by our print fulfillment partner and shipped directly to you.
2. Orders and contract
A contract is formed when we confirm your order and payment has been accepted. Order confirmations are sent by email. We reserve the right to decline or cancel an order, for example in case of a pricing error, fraud suspicion, or if the item can no longer be fulfilled — in which case any payment made will be refunded in full.
3. Prices and payment
All prices shown are in the currency displayed at checkout and are inclusive of applicable VAT (BTW). Shipping costs, where applicable, are shown separately before you confirm your order. Payment is processed securely through our payment providers (Stripe and/or Mollie). We do not store your full payment card details.
4. Right of withdrawal (herroepingsrecht)
As a consumer in the EU, you generally have the right to withdraw from your order within 14 days of receiving the product, without giving a reason, in accordance with the Dutch Civil Code (Burgerlijk Wetboek) and the EU Consumer Rights Directive.
Note on print editions: because each print is produced on demand from an existing image (rather than customised to your own specifications), we currently apply the standard 14-day withdrawal right rather than claiming a “custom-made goods” exemption. This position is under legal review and may be updated; the version in force at the time of your order applies.
To withdraw, contact info@gallory.net within 14 days of receipt, stating your order number. You are responsible for return shipping costs and for returning the item in its original condition. We will refund your payment, including standard delivery costs, within 14 days of receiving the returned item or proof of return shipment.
5. Delivery
Print editions are produced and shipped by our print fulfillment partner. Estimated delivery times are shown at checkout and are not guaranteed delivery dates. Risk of loss or damage passes to you upon delivery.
6. Use of the print
Your purchase grants you ownership of the physical print for personal, non-commercial use (e.g. display in your home). It does not transfer any copyright or intellectual property in the underlying artwork, which remains with the artist. You may not reproduce, resell as your own work, or commercially exploit the image.
7. Warranty and complaints
If your print arrives damaged, defective, or materially different from what you ordered, contact info@gallory.net with your order number and photos of the issue within a reasonable time after discovery. We will offer a replacement, repair, or refund as appropriate.
8. Liability
To the extent permitted by law, our liability is limited to the amount you paid for the relevant order. We are not liable for indirect or consequential damages. Nothing in these Terms limits liability that cannot be excluded under Dutch law (e.g. for intent or gross negligence).
9. Complaints and dispute resolution
We aim to resolve complaints directly — contact info@gallory.net. If we cannot resolve a dispute together, you may also use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
10. Governing law
These Terms are governed by Dutch law. Disputes will be submitted to the competent Dutch court, without prejudice to any mandatory consumer protection rights available in your country of residence.
11. Changes to these Terms
We may update these Terms from time to time. The version in force at the time you place an order applies to that order.
